Court orders NDLEA to produce Baba Suwe physically as agency denies him relief funds



  A Lagos High Court sitting in Ikeja, on Wednesday, ordered the National Drug Law Enforcement Agency (NDLEA) to produce star comedian and actor, Babatunde Omidina,  also known as Baba Suwe physically in court at its next adjourned date of November 1, 2011.
    Justice Yetunde Idowu granted the order, following an application for his production in court filed by his counsel, human rights lawyer, Bamidele Aturu, before the court.
    Aturu also sought through an application brought pursuant Order IV Rules 3 and 4 of the Fundamental Human Rights Enforcement Procedure Rules 2009 for the unconditional release of the comedian from NDLEA custody pending the hearing and determination of the substantive suit.
However, the NDLEA, through its counsel, Femi Oloruntoba, opposed the application to release Baba Suwe unconditionally through a 33- paragraph counter affidavit where it is claimed that a series of medical examinations had been carried out since the day Baba Suwe was arrested on October 12, 2011.
  NDLEA added that the examination results revealed that the applicant had a large amount of drug in his stomach, adding that Baba Suwe was bound eventually to excrete the substance from his abdomen.
  The agency added that it is not opposed to producing the applicant in court but was concerned that crowd control would be a problem but the judge told him that the court security would control any crowd and there would not be a problem
“We are not opposing the application. The applicant is in good condition. We urge the court to make such consequential order as to avoid a breach of peace,” Femi oloruntoba  said.
    NDLEA also said  Omidina’s arrest and detention were within the purview of the law and the Constitution, so he does not deserve the N100 million compensation and apology he is asking for.He is not entitled to any of the reliefs claimed, including the sum of N100,000,000.00 damages.”
